These Terms of Use ("Terms") govern your use of www.truecarefm.com (the "Website") and the text-messaging program described in Section 7, both operated by TrueCare Family Medicine, LLC ("TrueCare," "we," "us," or "our"). By using the Website or enrolling in our text-messaging program, you agree to these Terms and to our Website Privacy Policy. If you do not agree, please do not use the Website.
1. The Website is for general information
The Website describes our practice, membership options, and how to contact us. Its content is provided for general informational purposes only and is not medical advice, diagnosis, or treatment. Using the Website, sending us a message through it, or reading its content does not create a physician–patient relationship. Care is provided only under a signed membership agreement and the policies given to you by our office.
If you have a medical emergency, call 911 or go to the nearest emergency room. Do not use the Website or text messaging for urgent medical needs.
2. Membership and services
Enrollment in our direct primary care membership, the services included, fees, and cancellation are governed by the separate membership agreement you sign with our office, together with our published Return and Refund Policy. If these Terms conflict with your membership agreement, the membership agreement controls for matters of care and payment.
3. Acceptable use
You agree to use the Website only for lawful purposes and not to: attempt to gain unauthorized access to the Website, its hosting, or any related system; interfere with the Website's operation or security; submit false, misleading, or another person's information; use automated tools to collect content from the Website; or copy, reproduce, or distribute Website content except as permitted below.
Please do not submit birth dates, medical details, payment-card numbers, or other sensitive information through the public contact form. Current patients should use the communication channels provided by our office.
4. Content and intellectual property
The Website and its content, including text, images, logos, and the TrueCare name, are owned by or licensed to TrueCare and protected by copyright and trademark law. You may view and print pages for your personal, non-commercial use. Any other use requires our written permission.
5. Third-party services and links
The Website links to services operated by others, including our enrollment platform, patient portal, payment processing, and our website host. Those services have their own terms and privacy policies, which govern your use of them. We are not responsible for the content or practices of third-party services.
6. Privacy
Our Website Privacy Policy explains how we handle information collected through the Website. Medical records and other protected health information are governed by our Notice of Privacy Practices and applicable law.
7. Text messaging (SMS) terms
TrueCare Family Medicine provides recurring text messages through TrueCare Family Medicine Alerts about your clinic account, appointments, and care or support updates at the cell number you provide. Messages may include appointment reminders, prescription-status updates, billing and account notices, pre-visit instructions, patient-portal notices, security alerts, and responses to your support requests.

8. Disclaimers

Nothing in these Terms limits the care obligations set out in your membership agreement.
9. Limitation of liability
To the fullest extent permitted by law, TrueCare and its members, employees, and contractors will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of, or inability to use, the Website or the text-messaging program. This section does not limit liability that cannot be limited under applicable law, including for professional medical services provided under your membership agreement.
10. Governing law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law rules. Any dispute relating to the Website will be brought in the state or federal courts serving York County, Pennsylvania.
11. Changes to these Terms
We may update these Terms as our services or legal obligations change. The published Terms will identify their effective date, and continued use of the Website after a change means you accept the updated Terms.
